Court Strikes out Case Against Alagunjin of Agunjin Town.

The case against the Alagunjin of Agunjin in Ifelodun LGA of Kwara State was struck out by Honorable Justice M. O. Folorunsho of the Kwara State High Court on the 29th June, 2026.

It will be recalled that sometimes in September 2025, Prince Taye Bello of the Arojojoye Ruling House and 3 others instituted an action against Prince Isiaka Babatunde Adekeye, Ifelodun LGA, Attorney General of Kwara State and Governor of Kwara State, challenging the appointment of the 1st defendant as the Alagunjin of Agunjin

The Attorney General of Kwara State, Senior Ibrahim Sulyman on behalf of the 3rd and 4th Respondent filed a notice of preliminary objections which was heard by the court on the 30th April, 2026. The objection as argued by the learned Attorney General, challenged the competence of the suit and jurisdiction of the Court to entertain the suit on the grounds that the Claimants/Respondents failed to comply with the provisions of Chiefs (Appointment and Deposition) Law of Kwara State. it was further argued that the suit disclosed no cause of action and same is an abuse of court process.

The Counsel to the Claimants, Ibrahim Alabidun however in opposing to the Notice of preliminary objection argued that the conditions precedent as contained in the Chiefs Law were followed and urged the Court to dismiss the objection.

Honorable Justice Folorunsho in his ruling having carefully evaluated the legal arguments alongside the legal authorities including the provisions of the Chiefs Law of the State found merit the the preliminary objections and held that the suit as constituted was incompetent and not maintainable before the court. Hence the objection was upheld and the case was accordingly struck out with no order as to cost.
