Court slams KAM Steel N25m fine Over Illegal Detention of Employee for 23days

The Federal High Court in Ilorin has imposed a penalty of N25 million on Dr. Kamoru Yusuf and KAM Integrated Company Limited for the unlawful detention of their former employee, Mr. Samuel Oniyide, for 23 days.

Counsel for the applicant, Taiwo Hammed Esq and Tajudeen Abdullahi Esq, had filed a fundamental human rights case on behalf of his client against Dr. Kamoru and KAM Steel, whom the company accused of misappropriating over N5billion.

Justice Ariwoola Junior, who delivered the judgment on the matter, condemned the action, stating that Dr. Yusuf had no constitutional authority to detain Oniyide independently without a court order or police warrant.

The court also awarded huge some of amount as penalty against the Economic and Financial Crimes Commission (EFCC) for continuing an investigation already concluded by the police, describing it as an abuse of power.

In addition, the court awarded N5 million against the Chief Security Officer of KAM Company, Superintendent of Police Sodiq, for participating in the crime for executing the illegal detention order of Dr. Kamoru.

The Judge however exonerated the Commissioner of Police for not consenting to the detention.

Earlier, Oniyide, through his counsels, had appealed for assistance regarding Dr. Kamoru’s persistent police harassment, urging him to let the law and the court fulfill their roles concerning the case he had filed.
